Warning for non-serious broker

In Turkey, there are several non-authorized agents, which are not always serious, because they are only looking to earn quick money. At restaurants, bars and hotels in principle, there you can hit all these "kind and friendly" people who want to help you to buy a "good and cheap" real estate by a friend or relative who is the broker. This can be a very expensive business for you, the risk that you buy "a pig in a poke" is usually large, these "friends" are only trying to earn quick money. Therefore, do your business only with a professional broker who you know and who you can trust.

                                        Purchase price

The purchase price for installation costs with plot and villa  is  :

The purchase price will be paid from the customer as follows:

1. part payment:     10 % of the purchase price by contract signing

2. part payment:     20 % by completion of the bases

3. part payment:     20 % by completion of the shell

4. part payment:     20 % if windows, doors, tiles, electricity and sanitary works completed

5. part payment:     20 % by hand-over of keys

6 final payment:    10 % by assignment of land register

Requests of modifications or additions concerning the undersigned plans and the building specification are possible depending construction secton. The emerging additional costs are to be confirmed in writing before setting the work and payably by hand-over the keys.

                          

                           

                            Contract repudiation / Rescission of a contract

By rescission of the customer, if this happens not on grounds of the turkish

legislation or disregard from the contract of sale, so have the vendors the right on

requirements to the amount of the advance payment.

By rescission of the vendors the customer has the right on a requirement to the amount of the advanced payment.

                The vendors affirm adverse the customer, that 

a-) they are authorized to sell this in the contract designated real property,

 b-) the purchase price is a fixed price and additional claims on the part of the vendors are

      impossible. 

  c-) the object of purchase is free of debts and tax demands,

 d-) the purchase price is incl. fitted kitchen and white goods (as seen).

                                      Miscellaneous

The object of purchase cannot be disposed, debided or leased by the customer before he had paid the complete purchase price, unless the vendors give him an explicit consent in written form.

The customer receives from the vendors a guarantee of 10 years on construction work, material and statics. The object of purchase will be bought with all including rights and responsibilities free of debts .

The vendors are be bound, to give the purchase object up to the time of application of  the property owner at the land registry office for use to the customer.

Total costs of the contract and his enforcement,  plus all erising expenses and taxes, for example  real estate transfer tax and other expenses, bear the vendors.

The vendors concede and the customer submitted an instantiation of property according to existing turkish law at the registry of deeds Alanya and the creation of the refering tapu. The tapu will be hand out as soon as the client did the final payment.

The parties agree, that the legal rights to withdraw from the contract in the event of default  obtained to the vendors.

The parties agree Alanya as place for all commitments, except as noted otherwise. By the way the parties agree, that after international rights the right of this state will be applicable, where the  object of purchase situated is, accordingly the turkish right. This is also valid for the jurisdiction.

Verbal agreements between the parties of this contract are not valid. That applies also any additional agreement and the agreement concerning possibly abdication demand of written form.

Should one ordinance of this agreement being invalid, so it affects not the contract in his remaining parts. In lieu of the unvalid rules should be arranged an alternative rule, which comes as close as possible to both parties.
